Who Can File a Wrongful Death Lawsuit?

A personal representative of the deceased’s estate can bring a wrongful death claim. Other parties who stand to inherit the deceased’s property (if the deceased passed without a will) may also be able to bring a claim. For instance, the deceased’s surviving spouse would have a right to file a wrongful death action.
