Road Rage can result in Car Accidents and Personal Injury

Road rage has always been an issue, not only with California drivers, but with drivers around the country.  Incidents of road rage causing a variety of vehicle accidents are becoming more common as drivers take their aggression to the road.  Road rage often ends in serious personal injury, and in some cases, even death.

The movie “Last Exit” demonstrates the consequences of drivers becoming distraught, hurried, and frazzled behind the wheel of a motor vehicle.  This Hollywood movie features an auto accident brought on by road rage between two women .  One of the women in the film loses her life, and the other is bound to a wheel chair because of a severe injury to her leg.

In 1995, the American Automobile Association (AAA) conducted a survey to measure road rage. The findings showed that 90 percent of drivers claimed to have been either a victim of road rage or had witnessed a road rage incident.

Here are some safety tips when dealing with road rage, courtesy of www.dmv.org:

1.  It is important to understand that you cannot control another driver’s behavior. If you see an aggressive driver on the road, remember to “back off.”  Retaliation never ends well.  If you have been offended by an aggressive driver, the best thing you can do is to avoid confrontation.   By remaining calm, you can prevent risking injury to you or the passengers in your car. Aggressive drivers are usually unaware of their surroundings.  They are not calculating the consequences of their actions, which lead to accidents and injury.

2.  If you have been a victim of, or have witnessed road rage, DMV.org offers this advice: “Talk to a friend or family member about the driving experience… someone you can vent your frustration over the incident to.  Telling the story can reduce your stress.  Some driving clubs or online discussions offer members a chance to vent their frustration as well.”

3.  Another safety tip is to “Know Your Own Driving Style.”  Aggressive drivers often:

~  Tailgate.

~  Use their horn.

~  Flash their headlights.

~  Change lanes quickly and often.

~  Gesture to other drivers.

~  Talk on their cell phone.

Another Trial Victory!

Harris Personal Injury Lawyers is proud to announce another victory. Clients retained Harris Personal Injury Lawyers in May 2010. They had been involved in a rear end motor vehicle collision one year earlier. The insurance company for the defendant had told the clients for over a year that it would not pay the clients’ medical expenses, because they were not entitled to any medical treatment and simply could not have been injured in such a minor rear end collision.  The insurance company took a zero offer position on the clients’ bodily injury claim, despite the fact that they suffered back, neck, and jaw injuries.

The clients had an upcoming bench trial and were without representation.  Harris Personal Injury Lawyers agreed to take on the case and represent the clients at their upcoming bench trial.

Attorney Ryan Harris handled the bench trial with the assistance of the firm’s law clerk Garrett May.  Prior to the trial, the insurance company made no offers to settle the case.  The insurance company’s lawyer hired an accident reconstruction and bio mechanical expert.  This expert came to court and testified that the accident was very minor, and therefore, the clients could not have been injured in the collision. At the close of evidence, and after only deliberating for 5 minutes, the judge returned a $15,920.00 verdict in the clients’ favor.

11 Students Injured in School Bus Crash

Several students were injured Tuesday when a school bus was involved in a parking lot crash.

The Yuma, Arizona school district bus struck a light pole in the Golden Acorn Casino parking lot; located on the Campo Indian Reservation.

According to authorities, ten students suffered minor injuries, and one suffered moderate injuries. All eleven students were transported to Sharp Grossmont Hospital and Alvarado Hospital to receive treatment.

CHP reported a total of 45 people involved in the collision.

City Bus Involved in Hit & Run Collision

A Metropolitan Transit System bus was involved in a hit and run collision in City Heights, Wednesday afternoon.

A red Mitsubishi Eclipse heading south on 37th Street failed to stop at a University Avenue stop sign and struck the MTS bus at about 3:40 p.m., there were about 40 people on board at the time.

According to authorities, the ages of the nine injured ranged from 18 to 51, and all complained of back and neck pain. Two of the injured were considered serious.

The Eclipse hit the bus just behind the left front wheel and the impact of the collision spun the car around. The driver tried to flee, but the car, which had major front end damage, stalled a few feet away.

The suspect, described as a man between 18 and 25, was seen running north on 37th Street. San Diego Police is working to identify and locate the driver. An open container of alcohol was found inside the car, leading officers to believe he may have been driving while intoxicated at the time of the crash.

Motorcyclist Killed in Balboa Park Collision

San Diego—An auto accident at a Balboa Park intersection Friday afternoon leaves a motorcyclist dead, and a motorist arrested on suspicion of driving while intoxicated.

According to authorities, the 36-year-old motorcyclist was moving southbound on Florida Drive when an eastbound 2005 Volvo sedan pulled into his path at about 1 p.m.

The outcome of the crash launched the rider onto the roadway, where he was struck by a second vehicle.

Unfortunately the rider died at the scene.

The driver of the Volvo was arrested on suspicion of DUI and vehicular manslaughter.

Another Auto Accident Trial Victory!

Client retained Harris Personal Injury Lawyers in the Spring of 2007. She had been involved in a rear end motor vehicle collision 2 1/2 months earlier. The insurance company for the defendant argued that the client was not entitled to any medical treatment and could not have been injured in such a small collision.

The insurance company took this position on the client’s bodily injury claim, despite the fact that she suffered from a persisting neck injury. Attorneys Ryan Harris and Ryan Sargent tried the case in February 2010. Prior to trial, the insurance company had only offered $7,500 to settle the case.

Following a 4 day trial, the jury returned a $32,000 verdict, with $12,000 awarded for past medical expenses, $20,000 awarded for pain and suffering. In addition to the jury’s $32,000 verdict, the insurance company will also have to pay prevailing party costs, and CCP Section 998 interest and costs, of about $30,000, requiring a total payment of approximately $62,000 to satisfy the judgment.

Uninsured Motorist Arbitration Victory!

Client in San Diego County retained the Law Offices of Ryan Harris in the summer of 2007. He had been involved in a rear end motor vehicle collision two years earlier in the summer of 2005 and needed a personal injury attorney. The defendant did not have insurance, therefore, the client made a claim against his own automobile insurance company through his uninsured motorist coverage. However, rather than do the right thing, the client’s auto insurance company refused to honor its obligations under the client’s contract of insurance and improperly claimed the client’s neck and shoulder injuries were the result of an automobile collision the client had been involved in 2 months before the uninsured motorist collision. The insurance company took this position, despite the fact that the client did not have persisting neck pain until after the uninsured motorist collision.

The personal injury attorneys at the Law Offices of Ryan Harris arbitrated the case in February 2009. Prior to the arbitration, the insurance company had only offered $7,500 to settle the case, despite the fact the client had a $25,000 uninsured motorist policy limit with his insurance company. Following an all day arbitration, the arbitrator returned a $25,000 arbitration award, which is the maximum the arbitrator could award under the circumstances. In addition to the jury’s $40,000 verdict, the insurance company will also have to pay prevailing party costs, and CCP Section 998 interest and costs, of about $11,000, requiring a total payment of approximately $51,000 to satisfy the judgment.
